Regulatory Guidelines and Standards

Poisons are defined as any substances specified in the Schedule to the Poisons Act, Chapter 234. Any company, unless exempted under the Poisons Act, would need a licence for the purpose of import, possess for sale, sell or offer for sale any poisons.

For the purpose of retail sales of poisons, a Form C Poisons Licence under the Poisons Act is required. Only a registered pharmacist who intends to practice in a pharmacy is eligible to apply for a Form C Poisons Licence. .

As a pharmacist-on-charge of a registered pharmacy, the pharmacist must be working full time for the company. Other pharmacists who wish to work on a part-time basis may indicate their choice in the application form. Any pharmacist should not apply more than two Form C Poisons Licences.

For pharmacists who apply for a second Form C Poisons Licence, he/she should submit letters from both companies, authorizing the pharmacists to work for the other company.

Pharmacists rotating among the various pharmacy outlets registered under the same company are not required to submit amendment application to amend the pharmacy outlet and warehouse particulars reflected in their Form C Poisons Licences. However, this arrangement will not be applicable if the pharmacist is transferred to another outlet due to a closure of the pharmacy outlet where the pharmacist is licensed under. In such cases, the pharmacist will still have to submit an amendment application to ensure that he/she is holding a Form C Poisons Licence reflecting the particulars of a valid pharmacy. Please take note that the submission of an amendment application of the Certificate of Registration of a Pharmacy would be required if changes in pharmacist-in-charge are involved.
