Introduction
Attention is drawn to the provisions of the Smoking (Control of Advertisements and Sale of Tobacco) Act ("the Act") and the Regulations made under it. Licensees are reminded that they must comply with the obligations set out therein in addition to the conditions specified in the licence. Upon conviction for non-compliance offenders can be punished with imprisonment and/or fine. Offenders may also have their licenses suspended or revoked.
Advertisements Relating To Smoking
Advertisements relating to smoking are prohibited. Licensees must seek an exemption from the Authority from this requirement. (Section 3 of the Act)
Tobacco Products As Free Gift
Tobacco products must not be given away as a free gift, as a free sample or as a prize. Tobacco products also cannot be sold with other products as a free gift, or in conjunction with any other goods. (Section 9 of the Act)
Prohibition Of Sale Of Tobacco Products To Persons Below 18 Years Of Age
Licensees cannot sell, directly or indirectly, tobacco products to persons below the age of 18 years. Licensees are responsible for their employees and must ensure that their employees comply with this prohibition. (Section 10 of the Act)
No Sale Of Cigarettes In Package Of Less Than 20 Sticks
With effect from 1 December 2003, cigarettes packs that contain less than 20 sticks, must not be sold in Singapore. (Section 12 of the Act)
Notice of Prohibition
Sufficient notices that the sale of tobacco products to persons under the age of 18 years is prohibited must be prominently displayed. (Section 13 of the Act)
Prohibition On Sale Of Imitation Tobacco Products
There shall be no sale of any confectionary, food products, toys or any other article that is designed to resemble a tobacco product or to resemble the packaging associated with tobacco products. (Section 16 of the Act)
Health Warnings On Tobacco Products
Licensees must ensure that all tobacco products carry the mandatory health-warning labels in compliance with Section 17 of the Act.
Conditions for Display of Cigarettes
Since 1991, all retailers dealing in the sale of cigarettes must comply with the conditions for display of cigarettes for sale set by the Ministry of Health.
i) Only one packet of each cigarette brand is allowed for display.
ii) The showcase should be concentrated in one show area near the counter for sale of the cigarettes. All other packs for sale should be stored such that they are not visible to the customers or the public;
iii) Each outlet will have only one display area and for multi-layer supermarkets, one display area per floor.
